Busting HR Myths: 10 Truths You Can't Ignore

California employers face a steady stream of HR requirements, regulations and changing rules that make it difficult to separate what’s required from what’s become common practice.

Recently, Coastal Payroll presented a live webinar for California Bank & Trust clients focused on some of the most common HR compliance misconceptions employers encounter. The conversation explored where businesses may be taking on unnecessary risk, what California employers need to know, and how to stay ahead of requirements that can have a real impact on the workplace. ]

Each of these may sound like a reasonable defense, but in California, a common practice is not always a compliant one. Employee agreement, long-standing habits and even a well-written policy do not automatically mean your business is covered.

Below, we’re breaking down the myths, best practices and true legal mandates across three areas that commonly create confusion: leave and termination, timekeeping and wage and hour, and workplace policies.

LEAVE AND TERMINATION
What actually counts as a termination, when leave protections kick in, and what you owe employees on the way out.

"We have a 90-day probationary period, so we can term them without risk because they aren't even employees until they make it through that."

  • So-called "probationary periods" are not grounded in California law. There's no statute that creates a special employment status during those first 90 days.
  • Terminations conducted during a "probationary period" are no less risky than those conducted at any other time.
  • A "probationary period" can actually backfire on you if it implies a level of job security or process you don't intend to honor.

"We are laying him off, not terminating him. If we eliminate the position (or department), there is no risk."

  • Whether you're calling it a layoff, eliminating a position or department, discharging, firing, or "letting someone go" — legally, you are terminating.
  •  There are only two categories that matter: voluntary or involuntary termination. The label you use internally doesn't change which bucket it falls into or the obligations that come with it.
    "Maternity leave is six (6) weeks for a regular birth and eight (8) weeks for a C-Section."

  • Employees are entitled to 17-1/3 weeks of protected time off under the Pregnancy Disability Leave (PDL) law.
  • FMLA runs concurrently with PDL; then baby bonding (12 weeks under CFRA) begins following PDL.
  • Health insurance must continue under the same conditions.
  • CFRA leave may be taken intermittently.

"If the employee agrees to it, we can give them their final paycheck when we run the next scheduled payroll."

  • California is very serious about final pay timing and employee agreement doesn't change the requirements.
  • Involuntary termination: final pay is due at the time of termination.
  • Voluntary resignation with less than 72 hours' notice: final pay is due within 72 hours.
  • Voluntary resignation with 72 hours' notice or more: final pay is due on the final day of work.
    Miss the window, and the penalty is steep: one full day of pay for every day final pay is late, capped at 30 days — but that cap can still add up to a very expensive mistake.

    TIMECARDS & WAGE/HOUR
    How time gets tracked, who's on the hook when it's tracked wrong, and what "worked time" really means.
    "The practice of managing timecard input — aka 'Synthetic Timekeeping' — puts an employer at significant risk of violating the California Labor Code." 


     "Employers beware" the following with employee timecards:
  • Automatically deducting 30-minute lunches
  • Rounding time up or down on lunches or shift start-and-end times
  • Exchanging (approved or not) overtime for "comp time"
    "Non-exempt employees must be paid for every second they work — even when they're doing so voluntarily."
  • This applies even if the employer didn't approve it in advance.
  • It applies even if the employer told the employee not to — and they did it anyway.
  • It applies even when the employee voluntarily works through a meal period.
  •  It applies even if it's just checking email for five minutes after clocking out.

"We have employees approve their timecards, so we're protected if the hours are wrong."
 
The following are helpful, but not a full shield:

  • Attestations built into electronic systems that are agreed to by employees and timestamped.
  • Paper attestations for use with paper timekeeping systems, signed and dated, then verified by a supervisor or manager.
    However, all hours worked must still be paid — an approved timecard doesn't erase an employer's obligation if the hours recorded were wrong.

POLICIES
Where handbooks, acknowledgements, and time-off policies actually protect you — and where they don't."
If a policy is in the employee handbook and the employee signed an acknowledgement, we are protected."
 

Signed acknowledgements can definitely help. Here's when they don't:

  • When the policies in the handbook itself are outdated
  • When the policies are not aligned with the practices actually happening day to day
  • When the acknowledgements are worded in a way that is unconscionable

Bottom line: make sure your employee handbook is updated at minimum annually.

"Vacation time and Paid Time Off (PTO) are NOT interchangeable."

  • Both vacation and PTO are legally classified as "earned wages" and are never subject to "use it or lose it" policies and both require mandatory cash payout upon termination, and both can be capped.
  • Where they differ: vacation is strictly for leisure travel or personal time, while PTO is a broader bucket that includes vacation, personal, and sick time."

We have an unlimited PTO/Vacation policy, so we're not subject to all of those rules!"

 
Employers with unlimited PTO or vacation policies will definitely be under more scrutiny than those with standard policies. Be ready to answer:

  • On what criteria do you approve or not approve PTO or vacation?
  • How do you ensure consistency across the board?
  • What happens when an employee files a claim for unpaid, accrued time?

The common thread across all ten? Good intentions and “the way we’ve always done it” don’t always match what California law actually requires. Before relying on a long-standing practice, it’s worth knowing whether it’s a best practice, a myth or a true legal mandate, because getting it wrong can come with real consequences.Not sure where your current practices fall?
